Los Hechos

En otoño del 2009 Raintree anunció que se cobrarían cuotas especiales para mejorar el acceso en internet y otras amenidades dentro del resort, pero en lugar de hacer los cobros en un periodo considerable de tiempo y de manera justa, Raintree aceleró los cobros, y los propietarios tuvieron que pagar todo de manera rápida.

La “cuota especial” variaba  dependiendo del tipo de membresía con la que los socios contaban, pero esencialmente doblaba los “de por si” caros mantenimientos que los socios tenían que pagar, de esta manera, provocando que no todos los socios tuvieran suficiente dinero para pagar inmediatamente las fuertes sumas de dinero requeridas por Raintree para poder pagar el mantenimiento correspondiente y el nuevo cargo especial; poniendo en peligro su historial crediticio.

La acción

Esto generó inconformidades entre los socios y los llevo a demandar a Raintree Vacation club. La demanda fue elaborada por 11 residentes de california que poseían un tiempo compartido con Raintree Vacation Club (Hawai) y se les había cobrado un ”cargo especial” prácticamente de un día para otro, en el periodo de Octubre o Noviembre del 2009.

 Para Julio del 2010 los 11 querellantes presentaron dicha demanda y fue hasta Noviembre del 2011, después de más de un año de litigar y que la demanda en California fuera certificada como demanda colectiva ante el tribunal, que las partes involucradas llegaron a un acuerdo del litigio; todo esto gracias al apoyo de las pruebas antes presentadas por los demandantes.

La solución

Recientemente, el pasado 13 de marzo del año en curso (2012), el Tribunal publicó su Final Class Action Settlement Approval Order and judgment, aprobando el establecimiento propuesto y dejando como ganadores de la demanda a los socios de Raintree Vacation Club.

A continuación les presentamos en resumen, los beneficios para los miembros de la demanda colectiva establecidos en dicho acuerdo :

•    “Any unpaid amounts due on the Special Assessment and regular annual Club maintenance fees for 2010 and 2011, plus any interest and penalties, if applicable, will be waived and not collected or pursued for collection, upon a Settlement Class member’s payment of his or her 2012 maintenance fees.


•    Settlement Class members who paid the Special Assessment and/or paid 2010 or 2011 maintenance fees during a period when they were prevented from booking reservations because of the Special Assessment will receive “Supplemental Points” that they may use to book additional reservations at Club resorts to compensate them for such payments. Supplemental Points will be allocated to eligible members of the Settlement Class based on each member’s 2010 Club Points (or weeks) allotment as follows, depending on the payments each member has made:

1. Paid both the Special Assessment and Maintenance Fees for both 2010 and 2011    1. Will receive Supplemental Points equal to Member’s 2010 Points


2. Paid the Special Assessment, but did not pay Maintenance Fees for both 2010 and 2011    2. Will receive Supplemental Points equal to Member’s 2010 Points


3. Paid Maintenance Fees for either (but not both) 2010 or 2011, but did not pay the Special Assessment    3. Will receive Supplemental Points equal to Member’s 2010 Points


4. Paid Maintenance Fees for either (but not both) 2010 or 2011, plus the Special Assessment    4. Will receive Supplemental Points equal to 2x Member’s 2010 Points


5. Paid Maintenance Fees for both 2010 and 2011, but did not pay the Special Assessment    5. Will receive Supplemental Points equal to 2x Member’s 2010 Points
 
Members of the Settlement Class who paid nothing toward the Special Assessment and paid nothing toward 2010 and 2011 Maintenance Fees will not receive any Supplemental Points.
 
•    The Defendants will provide a detailed description of the actual uses of funds collected through the Special Assessment and will provide annual, independently audited financial information to Club members describing Club operation expenses, the fees charged to Club members and the uses of the fees collected.


•    No fees charged to Club members will increase because of the settlement.


Under the Settlement Agreement and Release, in exchange for the benefits provided, Defendants, Plaintiffs, Settlement Class members and the attorneys in the lawsuit agreed to mutually release each other from all claims that were asserted in the lawsuit, arise from the lawsuit or arise from the Special Assessment. The parties to the Settlement Agreement expressly agreed that this release does not extend to any future Special Assessment or any future alleged wrongdoing by the Defendants.”

    Es increible como esto de las estafas de los tiempos compartidos cada ves es mas comun , he escuchado a varias personas ultimamemente que han sufrido sobre estos abusos por parte del resort, mis papas tmb fueron estafados por lo cual me puse a investigar y fue como encontre muchos casos similares, que lo dificil es a la hora que quieres cancelarlo ya que te das cuenta que fue una estafa al comprar un tiempo compartido.

    own timeshare ten yrs. now I can't get rid of it. was told it was good investment , no problem getting rid of it. hogwash. I tried everything. the resort does not want anything to do with me now.

    I wanted to write a comment to support your work. We enjoy all inclusive resorts in Mexico but for sure have noticed the change of clientele in the resorts. It is so true that many guests no longer leave the resort unless they are going on a tour and the old Mexico we love is slowly drifting away. But, it was truly magical while it lasted!

    This isn't complicated: Just don't sign anything. If you think you might be interested in the timeshare, take the paperwork with you, study the contract carefully, run the numbers yourself and show it all to somebody who knows more than you do. Anybody who says "You have to buy now!" is conning you.

    I would like to get rid of my timeshare. I have had it 15 years but now at retirement age & cannot afford the yearly fees. It is paid for.

    I am not a tax person, nor do I own a time share. A friend of mine who does own a time share, donates his unused week(s) to Make a Wish. His time share is near Disney and allows a family of 4 to stay for free. He says he then can deduct some of the cost off his taxes.

    High pressure yes, Scam, not so much. As long as you are able to say no you will not have a problem.
